• Links to agent websites, manuscript wishlists, QueryTracker profiles, and other external resources

• We are not responsible for agent profiles being outdated, agencies closing, or agents moving to different agencies without notice.
• Querying and submission processes are handled by agents and agencies. We have no involvement in any query or representation processes.

5. Third-Party Links & Services

The site links to external websites including agency sites, agent profiles, manuscript wishlist sites, and industry directories. We are not responsible for the content, privacy practices, availability, or terms of any third-party site. Your use of those sites is at your own risk.

6. Privacy & Cookies

7. Intellectual Property

Upon receipt of a valid counter-notification, we may restore the removed content within 10-14 business days unless the original complainant files a court action seeking an injunction.

10. Disclaimer of Warranties

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, BOOK AGENTS NYC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SITE, INCLUDING DAMAGES RELATED TO INACCURATE AGENT INFORMATION, OUTDATED PROFILES, THIRD-PARTY CONTENT, OR UNAUTHORIZED ACCESS TO YOUR DATA.

In any case, our total liability to you shall not exceed $100 or the total amount you paid us (if any) in the 12 months before the claim arose, whichever is greater.

12. Indemnification

You agree to indemnify and hold harmless Book Agents NYC and its affiliates, officers, employees, and representatives from any claims, damages, losses, and expenses (including reasonable legal fees) arising from your use of the site or your violation of these Terms or any third-party rights.

13. Termination

We reserve the right to suspend or terminate your access to Book Agents NYC at any time, with or without cause, and with or without prior notice. Grounds for termination may include, but are not limited to:

• Fraudulent, abusive, or illegal activity
• Requests by law enforcement or government agencies

Effect of Termination: Upon termination, your right to use the site will immediately cease. We reserve the right to delete any data associated with your use of the site, though we may retain certain information as required by law or for legitimate business purposes.

Survival: Sections of these Terms that by their nature should survive termination will remain in effect, including but not limited to: intellectual property provisions, disclaimers, limitation of liability, indemnification, and dispute resolution provisions.
